These Terms of Service (the "Terms") govern your access to and use of Multibagger, the website at multibagger.app, and any related services (together, the "Service"), operated by the provider of Multibagger ("we," "us," or "the Operator"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. What Multibagger is, and is not
Multibagger is a research and information tool. It evaluates publicly listed companies for certain business characteristics and publishes ranked lists, metrics, and written research for general informational and educational purposes only.
Multibagger is not a broker, dealer, investment adviser, financial planner, or tax or legal advisor, and provides none of those services. Nothing on the Service is, or should be construed as, investment, financial, legal, or tax advice, a recommendation or solicitation to buy, sell, or hold any security, or an offer of any security. Using the Service does not create any advisory or fiduciary relationship between you and us. You are solely responsible for your own investment decisions and should consult a licensed professional and conduct your own due diligence before investing. Investing involves risk, including the possible loss of principal, and past or present business characteristics do not guarantee future results.
Some research, summaries, and written analysis on the Service are generated or assisted by automated systems, including artificial intelligence, and may contain errors, omissions, or outdated information. Such content is not reviewed for accuracy on a statement-by-statement basis, is not a statement of fact, and should not be relied upon as one. You should independently verify any figure or claim against the primary source filings before relying on it.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Service. If you create an account, you agree to provide accurate information and to keep your login credentials secure. You are responsible for all activity under your account. Notify us promptly of any unauthorized use.
3. Subscriptions and payment
Parts of the Service may be offered on a paid subscription basis. Where they are, pricing and billing terms are presented at the point of purchase, payments are processed by a third-party payment processor, and we do not store your full payment card details. Paid plans may renew automatically until cancelled, and you may cancel at any time effective at the end of the then current billing period. Except where required by law or expressly stated, fees are non-refundable. We may change pricing prospectively with notice.
Locked (promotional) pricing.If you subscribe during a sale, your rate does not increase when the sale ends; it stays locked for as long as your subscription remains active. In the rare event of a system-wide price change, we reserve the right to adjust prices, including locked rates, on at least 10 days' notice by email; you may cancel before any change takes effect.
4. Acceptable use
You agree not to:
- scrape, crawl, harvest, or use automated or bulk means to extract the market and fundamental data on the Service, or otherwise access the Service by automated means, except through an interface we expressly provide for that purpose (such as an official API);
- copy, export, or redistribute the third-party market and fundamental data other than viewing it within the Service;
- redistribute, resell, sublicense, or publish our research, the lists, or the rankings, in whole or in substantial part, as a standalone or competing dataset, feed, or product (quoting or sharing individual pieces of our research with attribution is permitted; see "Use of our research" below);
- reverse engineer or attempt to derive the methodology, source code, or non-public logic of the Service;
- circumvent access controls, rate limits, or paywalls;
- use the Service in violation of any applicable law or third-party rights, or to build or train a competing data or research product.
5. Intellectual property and use of our research
The Service, including its software, text, design, written research, and the selection, arrangement, and presentation of data and rankings, is owned by us or our licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service. All rights not expressly granted are reserved.
These Terms distinguish between (a) our research, meaning the written theses, the six-dimension assessments, scores, swing factors, and rankings we produce, and (b) the third-party market and fundamental data we display (such as Twelve Data and EDGAR figures).
Subject to your plan, we grant you a license to use our research for your own purposes and to quote or share individual pieces of it publicly with attribution; credit "Multibagger" and include a working link to multibagger.app. Commercial use of our research (for example, in paid, advisory, or other client-facing work) is available with an Analyst plan or a separate written agreement and does not require attribution. In all cases, you may not redistribute or republish our research in bulk, or in a way that reproduces a substantial part of the rankings or serves as a substitute for the Service.
The third-party market and fundamental data is licensed to us for display within the Service only. You may view it here, but you may not copy, export, scrape, or redistribute it.
6. Third-party data and sources
The Service incorporates market and fundamental data from third parties, including Twelve Data and U.S. Securities and Exchange Commission EDGAR filings, among others. Such data is provided by those sources "as is," may be delayed, incomplete, or contain errors, and remains subject to the terms and rights of the respective providers. We do not control and are not responsible for third-party data, and we do not guarantee its accuracy, completeness, or timeliness. This data is licensed to us for display within the Service only; you may view it but may not copy, export, scrape, or redistribute it.
7. No warranties
The Service and all content and data are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any information will be accurate or reliable.
8. Limitation of liability
To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost data, or trading or investment losses, arising out of or relating to your use of, or inability to use, the Service, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
9. Indemnification
You agree to indemnify and hold harmless the Operator and its affiliates from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service or your violation of these Terms or applicable law.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or to protect the Service. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.
11. Changes to the Service and these Terms
We may modify or discontinue the Service, and we may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12. Governing law and disputes
These Terms are governed by the laws of the State of Kansas, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Kansas will have jurisdiction over any disputes, except where applicable law grants you the right to bring a claim elsewhere.
We do not require you to resolve disputes through binding arbitration, and nothing in these Terms asks you to waive your right to bring or participate in a class or representative action. You keep whatever rights you have under applicable law to have a dispute heard in court.
